La política o plan como elemento contextual del crimen de lesa humanidad: Una mirada a los tribunales Ad Hoc y la Corte Penal Internacional

Resumen

Desde su aparición en el Estatuto del Tribunal Internacional de Núremberg, el crimen de lesa humanidad fue el que más evolucionó. Los elementos constitutivos del crimen fueron limitados y desarrollados por la jurisprudencia de los distintos tribunales internacionales. Entre aquellos, se destaca la exigencia de que las conductas violentas de los individuos se hayan llevado a cabo en función de una política o plan por parte del Estado o de organizaciones no estatales.

La cuestión de la política o plan no tuvo un tratamiento uniforme en la jurisprudencia internacional. El presente trabajo tiene por objeto brindar un acercamiento a dicho tratamiento por parte de los Tribunales Ad Hoc y la Corte Penal Internacional, mediante el análisis de la jurisprudencia más relevante al respecto. La finalidad no sólo es mostrar las diferencias que presentan sino también invitar a la reflexión, ya que la discusión no está zanjada.

Abstract

Since its first appearance in the Statute of the International Military Tribunal of Nuremberg, the crime against humanity was the crime category that evolved the most. The constitutive elements of the crime were developed and limited by the work and jurisprudence of the international tribunals. The requirement that the criminal acts were conducted in furtherance of a State or organisational policy or plan was one of the most controversial.

The issue of the policy element did not have a smooth and homogenised treatment in international jurisprudence. Thus, the present paper aims to present such treatment, focusing on the Ad Hoc Tribunals and the International Criminal Court’s jurisprudence. The objective is not only to show the difference between them, but also an invite to reflect on issues, that even now, are far from settled.
