The present work shows a conflict between culture and law, a situation that generates struggle in society, since some prioritize culture over law and others, on the contrary, consider that law must be fully respected over any social act. Argentina is a nation with a large population of gauchos, and it has a culture rooted in rural animals for various economic, social and cultural purposes. The work is developed from a culture-centered approach. A cultural and traditional activity called jineteada carried out in the Argentine Republic is considered an act of animal abuse since it consists of practising manoeuvres on the equine so that it moves in a way that the rider remains on the axis for a time. These manoeuvres generate several injuries or damage to the animal and cause even death. Although it is a legally regulated activity, it should be considered unconstitutional and illegal since it violates national and international regulations that protect the environment and animals by transgressing a constitutional right: the environmental law ruled in article 41 of the Argentine National Constitution. The prohibition of the jineteada should be analyzed due to the significant social rejection it brings because of its entertainment end, as citizens consider this tradition reprehensible given the visible abuse of the animal. It is for empathy that we look to protect and respect these living beings.
